Introduction

At OC Motorsport LTD, we supply high-quality automotive performance and tuning parts. We have observed an increasing number of customers purchasing major tuning components, including turbochargers, superchargers, ECU systems, and other specialist performance parts, and subsequently seeking to return them after having opened, handled, or attempted to fit them, without any fault being present in the product.

The cost of processing these returns is substantial. Unlike a standard retail order, we incur costs for the original processing, packing and shipping, followed by the costs of receiving, inspecting, testing, repackaging, and administratively processing the return. Critically, while the goods are in the customer's possession, they are removed from our available stock and might not be able to be sold to other customers. Where goods show signs of handling, fitting, or use beyond what is necessary to inspect them, their resale value is significantly diminished.

This policy is designed to protect our business from the considerable financial impact of such returns, while fully respecting our customers' statutory rights under UK consumer protection legislation.

Please see next page.

Important Note: Your Statutory Rights

Nothing in this policy affects your statutory rights. Specifically, this policy operates within the framework of:

  • The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCRs") – which provide a 14-day right to cancel for most distance contracts.

  • The Consumer Rights Act 2015 ("CRA") – which provides rights in respect of faulty, not-as-described, or not-fit-for-purpose goods.

Where any term of this policy is inconsistent with your statutory rights, your statutory rights shall prevail. However, the CCRs permit a trader to make deductions from a refund where the value of the goods has been diminished by handling beyond what is necessary to establish their nature, characteristics, and functioning. This policy clearly sets out how we will assess such diminished value for performance automotive parts.

    1. Definitions

For the purposes of this policy:

  • "Major Tuning Parts" means any turbocharger, supercharger, intercooler, engine management system (ECU), fuel system component, exhausts, internal engine component (including but not limited to pistons, connecting rods, camshafts, valves, and gaskets), forced induction kit, or any other component that, in OC Motorsport LTD's reasonable assessment, requires specialist technical knowledge for correct installation and where improper installation may affect the safety, performance, or integrity of the part or the vehicle to which it is fitted.

  • "Standard Parts" means any product supplied by OC Motorsport LTD that does not fall within the definition of a Major Tuning Part.

  • "Fitting" includes any attempt to install, mount, connect, or integrate a product with a vehicle, whether successful or not, and includes the removal of protective coatings, the application of sealants or gaskets, the connection of electrical or fluid lines, and any marking, scoring, or witness marks consistent with installation activity.

2. Returns of Non-Faulty Goods – General Conditions

This section applies where goods are not faulty, not damaged, not incorrect, and not in breach of your rights under the CRA.

2.1 Your Right to Cancel

Under the CCRs, you have the right to cancel your order within 14 calendar days from the day after you receive the goods. If you wish to cancel, you must notify us of your decision by a clear statement (for example, by email). You then have a further 14 calendar days from the date of your cancellation notice to return the goods to us.

2.2 Condition of Returned Goods

All returned goods must be:

  • Unused, unfitted, and in the same condition as when they were supplied.

  • In their original, undamaged packaging with all accessories, instructions, and

    documentation included.

  • Free from any markings, scratches, witness marks, sealant residue, or other

evidence of fitting or attempted fitting.

  • Complete with any security seals, tamper-evident labels, or protective coatings

    intact.

Goods that do not meet these conditions will not be accepted for return or will be subject to a significant deduction for diminished value – see Section 3 overleaf.

2.3 Items That Cannot Be Returned (Non-Cancellable)

The right to cancel under the CCRs does not apply to:

  • Goods that have been made to your specification or are clearly personalised (bespoke or custom-made goods). This includes brake lines where the customer has chosen the colour, length or fitting type for their application.

  • Goods that have been inseparably mixed with other items after delivery.

  • Sealed goods that are not suitable for return due to health protection or

    hygiene reasons, once unsealed.

In addition, due to safety and traceability requirements, the following categories of goods are non-returnable once supplied:

  • Electrical and electronic components (including sensors, control units, ECUs, and lighting assemblies).

  • Keys, locks, and VIN-specific components.

3. Major Tuning Parts – Enhanced Inspection and Deduction Provisions

  • This section applies specifically to Major Tuning Parts and forms a critical part of our returns policy. By placing an order for any Major Tuning Part, you acknowledge and agree to the terms set out in this Section 3.

3.1 Rationale

Major Tuning Parts require specialist technical knowledge, tools, and conditions for correct installation. We have experienced a pattern of customers purchasing such parts and attempting to fit them, only to discover they lack the requisite skills, tools, or facilities. The parts are then returned having been handled, marked, or partially installed.

Such handling invariably diminishes the value of the goods substantially, as they can no longer be sold as new and may require reconditioning or testing before resale. Some parts, once fitted, cannot be resold at all due to safety and warranty implications.

3.2 Mandatory Pre-Return Contact

Before returning any Major Tuning Part, you must contact us by email at info@oc-motorsport.co.uk to discuss the return. This is a mandatory requirement. We will not process a refund for a Major Tuning Part returned without prior email authorisation.

During this contact, we will discuss:

  • The reason for your return.

  • Whether any fitting or handling has occurred.

  • The likely inspection process and any associated fee.

We will then issue a Return Merchandise Authorisation (RMA) number, which must be included with your return. Any Major Tuning Part returned without a valid RMA number will be rejected and returned to you at your cost.

3.3 Technical Inspection

All returned Major Tuning Parts will be subjected to a thorough technical inspection by our qualified staff. This inspection will determine, at our reasonable discretion:

  • Whether the part has been fitted, partially fitted, or attempted to be fitted.

  • Whether the part shows any signs of handling beyond what is necessary to

establish its nature, characteristics, and functioning (the "Permitted Handling

    Standard").

  • The extent to which the value of the part has been diminished because of such

    handling.

  • Whether the part can be resold as new, requires reconditioning, or cannot be

    resold at all.

For the avoidance of doubt, the following activities all constitute
handling beyond what is necessary to establish the nature, characteristics, and functioning of a Major Tuning Part, and will result in a diminished value deduction:

  • Unwrapping or removing protective coverings, caps, or seals beyond the minimum necessary for visual inspection.

  • Connecting the part to a vehicle's electrical, fluid, or mechanical systems.

  • Applying any torque, force, or tool to the part.

  • Marking, scoring, or abrading any surface of the part.

  • Applying any sealant, gasket compound, thread lock, or similar product to the

    part.

  • Removing or altering any manufacturer markings, labels, or serial numbers.

3.4 Return Fee for Major Tuning Parts

Where a Major Tuning Part is returned and our inspection reveals handling beyond the Permitted Handling Standard, we reserve the right to deduct from your refund an amount reflecting the diminished value of the goods, up to the full purchase price of the goods, as permitted by Regulation 34(9) of the CCRs. This is not a penalty or a restocking fee; it is a deduction to reflect the loss in value caused by your handling.

The amount of the deduction will be determined by OC Motorsport LTD following inspection and will be agreed in writing (by email) with you before the refund is processed. We will provide you with a written explanation of the deduction, including details of the handling identified and how it has affected the value of the goods.

The deduction will be calculated by reference to the following:

  • No handling beyond Permitted Handling Standard: No deduction. The part will be refunded in full (less any applicable return postage costs if not pre-paid by us).

  • Minor handling beyond Permitted Handling Standard (e.g., opened packaging beyond what was necessary, minor cosmetic marking): A deduction of between 10% and 30% of the purchase price, reflecting the reduced resale value of a product that can no longer be sold as "new, unopened."

  • Evidence of fitting or attempted fitting (e.g., witness marks, sealant residue, electrical connection marks, missing protective caps): A deduction of between 30% and 75% of the purchase price, reflecting the substantial reduction in value and the costs of inspection, testing, and potential reconditioning.

  • Significant handling rendering the part unsaleable as new (e.g., damaged threads, missing components, permanent modification, internal contamination): A deduction of up to 100% of the purchase price may be applied. In these circumstances, we may, at our discretion, offer to return the part to you at your cost.

Where we are unable to resell the part at any value due to the extent of handling or attempted fitting, no refund will be payable. In such cases, we will contact you to arrange return of the goods to you at your expense.

3.5 Agreement of Deduction

No refund for a Major Tuning Part will be processed until you have been notified of the proposed deduction and have confirmed your acceptance by email. If you do not agree with the proposed deduction, we will provide you with the evidence from our inspection and discuss the matter with you. If agreement cannot be reached, we will return the goods to you at your cost, and no refund will be issued.

4. Returns of Standard Parts (Non-Major Tuning Parts)

For Standard Parts returned within the 14-calendar-day cancellation period, the following applies:

  • Where goods are returned in accordance with Section 2.2 above (unused, unfitted, original packaging intact), you will receive a full refund of the purchase price. You are responsible for the cost of returning the goods to us unless we have agreed otherwise in writing.

  • Where goods show evidence of handling beyond what is necessary to establish their nature, characteristics, and functioning, we reserve the right to deduct an amount reflecting the diminished value, in accordance with Regulation 34(9) of the CCRs. This deduction will be notified to you before the refund is processed. If agreement cannot be reached, we will return the goods to you at your cost, and no refund will be issued.

  • Return of Standard Parts after the 14-day cancellation period has expired: A restocking and handling fee of 20% of the purchase price will be deducted from any refund, provided the goods are returned in a condition meeting Section 2.2. This fee reflects our internal processing, inspection, and restocking costs. Returns of Standard Parts will not be accepted more than 30 calendar days after delivery unless we agree otherwise in writing.
Please note after the standard 14-day cancellation period OC Motorsport Ltd Reserve the right to refuse a customer’s request to return an item.

5. Faulty, Damaged, or Incorrect Goods

If goods arrive damaged, defective, or incorrect, you must notify us within 7 calendar days of receipt (or within 30 calendar days if claiming your short-term right to reject under the CRA).

  • Contact us by phone on 01268 906380 or by email at info@oc- motorsport.co.uk to report the issue.

  • We will arrange for the return of the goods at our cost.

  • Upon receipt and confirmation of the fault, damage, or error, we will, at your

option, provide a full refund (including any standard delivery charges) or a

    replacement.

  • Replacement goods will not be dispatched until the original goods have been

received and inspected by us, unless we agree otherwise in writing.

  • If goods returned as faulty are found upon inspection to be fully functional

and free from defects, the return will be treated as a return of non-faulty goods under Section 2, 3, or 4 of this policy (as applicable), and any applicable deductions or fees will apply. You will also be responsible for the cost of returning the goods to you if you wish to have them back.

6. Warranty Policy

6.2 Obligation Under Warranty

OC Motorsport LTD's sole obligation under this warranty is limited to repair or replacement of the defective product or component, at our discretion. • Improper installation or installation by a person not possessing the requisite

    technical qualifications, skills, or experience.

  • Unauthorised repair, modification, or tampering.

  • Use outside the manufacturer's specified operating parameters.

    manufacturer recommendations.

product is specifically rated and sold for such use and warrantied by the manufacturer). If in doubt about the warranty for such products we suggest you confirm with OC Motorsport Ltd before purchasing.

For the avoidance of doubt, this warranty does not cover any damage, defect, or failure arising from or contributed to by the customer's or any third party's improper installation of the product, regardless of whether the product itself was defective at the point of supply.
